Booking - Terms and Conditions
1. THE CONTRACT
- The Property known as "El Reflejo", situated in Tabernas, Almeria, Spain, is offered for holiday rental subject to confirmation by the Owner to the Guest.
- The Booking Conditions and the contents of this web site represent the terms and conditions and the rental agreement between the Owner and the person signing the Booking Form.
- This person is solely responsible for this agreement and no other person or persons can take over this agreement.
- No amendments or alterations can be made to this Contract.
2. BOOKING ENQUIRY
- After your initial Booking Enquiry from this website, the owner will contact you to discuss your requirements.
3. RESERVING "EL REFLEJO"
- To reserve "El Reflejo", the Guest must then complete the online booking form, a link for which will be sent you by the Owner, and make the payment, via Paypal, of the initial non-refundable deposit of 25% of the total rent due for the period booked, this amount forms part of this agreement.
- Following receipt of the booking and deposit, the Owner will send a confirmation invoice. This is the formal acceptance of the booking.
- There will be a 3% booking fee to cover any transaction fees incurred in the payment process from the third party payment gateway.
4. SECURITY DEPOSIT
- A security deposit of €500 together with balance of the rental amount is payable not less than four weeks before the start of the rental period. If this payment is not received by the due date, the Owner reserves the right to cancel the reservation, and retain the 25% deposit.
- The security deposit is required in case of any damage to the Property or its contents. The security deposit is refundable in whole or in part, within 14 days of your return home and after the property has been checked.
- All breakages, losses or damage and extra costs or charges will be deducted from this security deposit.
- Should the security deposit be insufficient to meet such costs or liabilities, an additional amount is payable by the person who signed the booking form.
5. CANCELLATION
- If cancellation is made more than ten days before the booking date the Owner has the right to retain the 25% deposit.
- If cancellation is less than ten days before the booking date, the Guest must pay 50% of the total rent for the booking period.
6. INSURANCE
- THE GUEST IS STRONGLY RECOMMENDED TO ARRANGE A COMPREHENSIVE TRAVEL INSURANCE POLICY, INCLUDING CANCELLATION COVER, AND TO HAVE FULL COVER FOR THE PARTY'S PERSONAL BELONGINGS, LOSS OR DAMAGE TO THE PROPERTY, PERSONAL INJURY AND PUBLIC LIABILITY. THESE WILL NOT BE COVERED BY THE OWNER' INSURANCE.
7. DAMAGES
- The Guest will report to the Owner without delay any defects in the Property or broken appliances in or around the Property, garden or swimming pool and the Owner or her agents will make arrangements for repair and/or replace them as soon as possible.
- The Owner or her agents reserve the right to enter the Property at any time to deal with any such problem or complaint. If a complaint is received, the Owner will do her best to facilitate a speedy and mutually satisfactory solution.
8. ROUTINE MAINTENANCE
- The Owner or her agents reserve the right to enter the Property at reasonable times to carry out normal and routine jobs including gardening, cleaning, pool maintenance and general care taking.
9. OCCUPANCY
- The Owner reserves the right, without refund, to terminate any reservation, or requests additional payment, if the number of people staying at the Property exceeds that stated occupancy on the booking form.
- If, however, the guests are planning to have other persons visit them, they may do so with the express permission of the Owner and upon paying any fees relating to the additional work necessary to facilitate this.
10. PETS
- Pets are only permitted on the premises with the express prior permission of the Owner.
11. CHANGES TO PREMISES
- Though the Owner makes every possible effort to ensure that the details contained on this web site are accurate, the house may be altered and facilities changed without prior notice.
12. RENTAL PERIOD
- The rental period is from SATURDAY to SATURDAY ONLY.
- The guest will be able to access the premises from 3 p.m. on the day of arrival and is requested to vacate the premises before 10 a.m. on the day of departure.
- Although, the Owner is not obliged to offer the accommodation before the time stated and the Guest is not entitled to remain in occupation after the time stated, under certain circumstances the Owner will endeavour to offer facilities as necessary, such as baggage storage.
13. LIABILITY
- The Owner is not liable nor will any compensation be paid by the Owner if anything occurs beyond the control of the Owner, including any temporary defect or stoppage in the supply of public services to the Property, nor in respect of any appliances in the Property, garden or swimming pool.
- The Owner will also not be liable nor will any compensation be paid by the Owner for damage or injury, which is the result of adverse weather conditions, riot, war, strikes or other reasons beyond the control of the Owner.
- Should the Owner have to cancel your holiday due to circumstances beyond her control, all monies paid will be refunded.
14. LEAVING THE PREMISES
- The Guest agrees to be considerate and to take good care of the Property and to leave it in a clean and tidy condition at the end of the rental period.
- A final cleaning service between changeovers is included in our price.
- However, the Owner reserves the right to make a retention from the security deposit to cover additional cleaning costs if the Guest leaves the Property in an unacceptable condition.
15. UTILITIES AND CONTENTS
- All utilities are included in the rental on the basis that their use is reasonable.
- An inventory of contents is available for the Guest's perusal.
- Towels and Bathrobes provided in the bathrooms must not be used for the pool or beach.
- Pool towels are provided for use at the Property only. It is recommended that you bring your own beach towels.
16. NATURE
- "El Reflejo" is a rural country property, and therefore you must expect the presence of animals, birds, reptiles and insects which may be heard or seen in and around the Property.
